Selling an RCFE Business When You Lease the Building
Episode published October 17, 2026
When an RCFE operator leases its home, the facility’s future depends on two connected arrangements: the business transfer and the right to keep operating at the property. Planning for both early helps an owner explain the opportunity clearly to a prospective buyer.
Clarify the lease before marketing
Read the full lease and every amendment. Identify the remaining term, renewal options, assignment or change-of-control requirements, rent adjustments, repair duties, and any landlord consent conditions. Ask a qualified attorney to explain provisions that may affect a transfer. Avoid assuming that a buyer can simply step into the existing agreement.
Coordinate landlord and buyer conversations
Prepare a factual summary of the lease and determine who should approach the landlord, when, and with what information. A buyer will want enough time to assess whether the site, term, and rent support the proposed operation. Keep sensitive information controlled and follow professional advice about confidentiality.
Questions to bring to your next conversation
- What approvals are needed for an assignment or ownership change?
- How much lease term and renewal runway would a buyer need?
- Do the rent and operating assumptions work together?
